DELIVERY TIME
The delivery date depends on the type of goods ordered. If no delivery date has been agreed upon, the seller shall deliver the goods without a request from the buyer within a period reasonable given the nature of the goods and the place of delivery. In the vast majority of cases, it ranges from 1 to 5 business days.
The Seller undertakes, to the best of its ability and in the interests of both itself and the Buyer, to select a delivery time and method of transport such that the delivery time and reasonable shipping costs are in accordance with customary practice. Partial deliveries are permitted unless expressly agreed otherwise.
DELIVERY METHODS, SHIPPING OF GOODS, AND SHIPPING COSTS
Depending on the method of delivery, delivery of the goods is deemed complete, in the case of in-person pickup, upon handover of the goods to the buyer at the seller’s place of business or upon the buyer’s acceptance of the goods from the seller at the destination; in all other cases, upon handover of the goods to the first carrier for transport to the destination.
In-person pickup is available only by prior arrangement at the seller’s headquarters or, if applicable, at one of its sales offices. This pickup method is generally available free of charge.
If the buyer does not pick up the goods in person, the goods will be delivered to the destination either directly by the seller or its business partner, or via a public carrier. Delivery means the pickup and delivery of the shipment to the loading dock or an open area at the destination, but using the buyer’s handling equipment and personnel (e.g., forklift, pallet jack, etc.). The carrier does not provide any additional services at the destination (e.g., delivery to a specific floor, to a warehouse, etc.).
If the method of shipment is agreed upon based on a specific request by the buyer, the buyer bears the risk and any additional costs associated with that method of shipment.
If, under the terms of the sales contract, the seller is obligated to deliver the goods to the location specified by the buyer in the order, the buyer is obligated to accept the goods upon delivery. If, for reasons attributable to the buyer, the goods must be delivered repeatedly or by a method other than that specified in the order, the buyer is obligated to pay the costs associated with the repeated delivery of the goods or the costs associated with the alternative delivery method.
In the event that the buyer refuses to accept the delivery without cause, a contractual penalty of 20% of the delivery price, including VAT, is hereby agreed upon, which the buyer is obligated to pay to the seller. Payment of the penalty does not relieve the buyer of the obligation to compensate the seller for any damages incurred as a result of the futile shipment of the goods.
Upon receiving the goods from the carrier, the buyer is required to check that the packaging is intact and, in the event of any defects, to report this to the carrier immediately. If the packaging is found to be damaged in a way that indicates unauthorized access to the shipment, the buyer is not required to accept the shipment from the carrier; however, the buyer is required to make a note of this on the waybills or similar delivery documents. Individual shipments are generally delivered via a public carrier. The shipping cost will be communicated to the customer upon order confirmation, unless it was already specified during the ordering process through the e-shop.
If the seller delivers the goods to the destination by car or other means of transport using the seller’s own vehicles or, as the case may be, through contractual partners, the shipping cost will be communicated to the customer on an individual basis upon order confirmation.
